Child Visitation During Summer

If you’re going through a divorce, your children are usually your first concern. Whether you are the primary parent or not, you obviously have questions about your children’s visitation schedule. While visitation schedules vary widely, there are several basic templates that are often employed. Summer visitation schedules, however, generally have more variability built-in than doing schedules for the school year. Summer Visitation Schedules

When it comes to your children’s visitation schedule, it’s likely to be a bit different in the summer. Typically, the parent who doesn’t have primary child custody will have a visitation schedule that includes every other weekend and one night during the week throughout the school year. Regardless of that visitation schedule, however, the parent who is not the custodial parent will often be granted more visitation and more visitation flexibility during the summer months. 

The State of Texas has a summer possession schedule in place that allows a predetermined number of days for summer visitation, which includes miles traveled in the calculation, as follows:

  • 30 days for parents who live within 100 miles of their children
  • 42 days for parents who live more than 100 miles from their children

Your Parenting Plan: Making Visitation Schedules

Ultimately, you and your ex-spouse will have a parenting plan that should include your children’s visitation schedule – including plans for a summer schedule. The fact is that most of our schedules are a bit looser in the summer – the kids are out of school, and families plan their summer vacations, kids might go camping, and you may plan other fun activities. The summer visitation schedule in your parenting plan should take this into careful consideration. 

Planning Ahead

Summer schedules can get tricky – because, after divorce, you will both naturally want to have summer holidays and outings with your children. This makes planning ahead and compromising imperative. While you obviously will not know your summer schedule years in advance, you can include scheduling deadlines. In fact, the State of Texas has guidelines on the matter, including:

  • The parent seeking visitation should provide the parent with primary custody with a proposed extended summer-visitation schedule by April 1 (or by a mutually agreed upon date).
  • If the parent misses this deadline, default summer visitation dates are July 1 through July 31 for parents who live within 100 miles of their children and June 15 to July 27 for parents who live more than 100 miles away.
